网络舆情折射下的公众法律意识探微——对药家鑫案的别样透视

网络舆情折射出的公众法律意识现状是无法令人满意的:传统法律意识、非法律意识还在干扰现代法律意识的形成;公众的法律知识还很贫乏;更令人堪忧的是,公众的法律信赖意识严重不足;此种状况既根源于历史的纠结,亦植根于现实的阻隔。法学界法律信仰的推崇派和怀疑派的对立实际上是西方自然法学、新自然法学与法律实证主义、法律现实主义对立的中国翻版,各有自身的关切及存在的合理性。一种更为可能的公众法律意识、法律观念演化的路径是:由法律怀疑到法律信赖、由法律信赖到法律信仰。

Research into Law Consciousness of the Public Reflected in Onling Opinions: A Particular Case Study of Yao Jiaxin

Law consciousness of the public reflected in online opinions is unsatisfactory because the traditional law consciousness and unlawful consciousness stil interfere the formation of modern law consciousness.The public are poor in law knowledge and even lack of law credit,which originates from the tangled history and separated reality.The counterparts of the cons and scepticism of law belief are related with western natural law,new natural law,law empiricism,law realism,which is embodied in Chinese society with respective concern and rationality of existence.Then the paper points out that the solution to arousing the law consciousness of the public is to change from law scepticism to law trust and from law trust to law belief.
