多层治理与欧洲联盟的合法性

20世纪90年代"许可共识"的结束使合法性问题成为欧盟政治的核心,理论界展开了关于欧盟合法性问题的大讨论。本文在概述欧洲一体化主流理论对欧盟合法性问题的分析基础上,侧重分析多层治理这一新的研究视角对理解欧盟合法性问题的贡献及其存在的问题。多层治理试图突破传统的国家主义合法性分析模式,以更符合欧盟政体多层次、竞争性特点的方式来重新思考欧盟的合法性、认同、代表性等问题。与传统的理论视角相比,多层治理的确指出了经常被人们忽视的欧盟合法性的来源,强调了从不同层面和以不同方式增强欧盟合法性的重要性。

Multi-Level Governance and the Legitimacy of the European Union

The problem of legitimacy has become the core issue of European Union politics following the end of the permissive consensus in the early 1990s.There has been wide debate on the issue.Based on a brief analysis of major theories of European integration on the problem of EU legitimacy,this paper focuses on contributions and shortcomings of multi-level governance perspective on EU legitimacy.Multi-level governance perspective has tried to break away from traditional statist approaches to the problem of legitimacy and to reconsider the problems of EU legitimacy,identification,and representation in a way which is more appropriate to the multi-level,competitive EU polity.Compared with traditional perspectives,multi-level governance approach does point out the often neglected sources of EU legitimacy,and highlight the importance of strengthening the legitimacy of the EU from different levels and in different forms.
