目标与路径：新型农村合作医疗法律问题研究

当前我国新型农村合作医疗制度在目标和路径上均面临着困境：就目标而言,由于受到传统合作医疗制度能够全面解决农村医疗卫生问题的影响,人们在新时期不同的条件下对新型农村合作医疗制度的存在过高的期待,因此,将新型农村合作医疗制度定位为单纯的基本医疗保健,并辅之以与新型合作医疗并行的医疗救济制度,才可能较为全面地解决农村的医疗卫生问题;同时,在新型农村合作医疗制度的实验阶段,有必要以政策之治的方式予以推进,但是对于新型合作医疗制度的巩固,则必须依靠法治的路径加以维持。
