摘    要:按揭符合抵押的本质特征.其特性在于:按揭人须提供有效的购销合同并对合同的标的物设按揭;购销合同的买受人、按揭合同的按揭人和贷款合同的债务人须为同一人.且按揭权人须为银行;按揭合同与购销合同之标的物具有同一性。在我国。“按揭”应成为立法术语.且将之定性为特殊抵押。在按揭贷款的条件、主客体、按揭权行使条件。以及供应商连带保证责任或回购义务等诸方面予以规范。

Abstract:The features of mortgage lie in these aspects: a mortgagor shall offer a valid purchase contract and mortgage the contract object only;the purchaser, mortgagor and obligor shall be the same person and the mortgagee shall be the bank;the objects tendered for in mortgage contract and purchase contract shall be the same.In China,mortgage shall be legally defined and standardized.
