论徽商的"好讼"

在“无讼”的传统法律意识下，论者分析缺乏国家法律制度的有效保护下，徽商惟有主动依附封建政治势力，锻造出徽商“好讼”性格，也不可避免地给徽商的发展带来诸多弊害。以史为鉴，一方面尝试着在传统徽学研究领域里，开辟出以法律史学的视角研究徽商的一块新领域；另一方面也为我国当今市场经济体制改革过程中，为立法者如何处理好“官”与“商”之间的和谐关系，提供历史借鉴。

On Huizhou Merchants' Litigiosity

This article points out that under the traditional legal background ——no litigation, Huizhou merchants had to try to get protections from feudal political force for lack of effective protections from the national legal system. Finally they preferred litigating when they had problems. However, it is inevitable to bring out negative results for Huizhou merchants＇ development. Based on history, on the one hand, this article tries to explore a new field in studying the Huizhou merchants from the perspective of legal history; on the other, it can provide the legislators with experience to handle the relationship between officials and merchants during the process of improving the market economy in China.
