政府采购作为一种新兴的市场经济行为，是调节宏观经济最直接的手段。通过政府采购不仅可以节约资源，保护民族产业，而且可以提高工作效率、防止腐败。然而在政府采购货物、工程或服务的过程中，供应商以追求企业利益最大化为目的，以牺牲国家利益和社会公共利益为代价，向政府采购相对人及其职员或代理人进行的提供或许诺某种利益，从而实现采购交易的不正当竞争行为即为商业贿赂。政府采购领域的商业贿赂不但给国家带来了巨大的损失，扰乱社会主义市场经济秩序，降低市场配置资源的效率，也给社会造成了严重的伤害，妨碍反腐倡廉进程，影响社会主义

However in government procurement of goods, works or services, suppliers is in pursuit of the maximum profits of enterprises, at the expense of national and social public interests. They provide or promise government procurement relative persons, their staff or agents some of the benefits in order to achieve procurement transactions, which belong to acts of unfair competition commercial bribery. The state commercial bribery in the field of government procurement has not only brought enormous losses, disrupted the socialist market economic order, reduced the efficiency of market allocation of resources, but also caused serious injury in the community, hindered the process of the anti-corruption campaign, and impacted on the construction of a socialist harmonious society. Governance areas of commercial bribery in government procurement should be taken to improve the anti-commercial bribery laws and regulations, and a sound social credit system exerts its financial market regulatory function of the allocation of resources, and to increase government procurement supervision, checks and other measures.
