| 摘 要： | 在宪法性权利话语遮蔽下,美国刑事司法对口供仍有较强依赖。米兰达规则的变迁、辩诉交易制度的盛行都是这种依赖的突出表现。口供依赖主要是口供独特的证据价值、侦查技术局限性与诉讼成本等客观因素,以及侦查机关的利益驱动造成的。美国刑事司法通过两个途径基本实现了口供获取手段的正当化。考察美国口供依赖对我国审讯制度改革目标与路径有一定启示。 |

| Abstract: | There is still a strong confession-dependence orientation in American criminal justice under the shadow of rights rhetoric.The fate of Miranda rule and the wide spread of plea bargaining are two typical examples of this orientation.Confession-dependence is mainly of evidence value for confession particularity.Other reasons are also analyzed.Two means for the justification of the confession-obtaining system are exploited.Inspiration can be drawn from the reality above in the reform of interrogation system in China. |
