论商业贿赂行为的法律规制

“商业贿赂”作为一种不正当竞争行为，也是腐败的重要表现。它不仅破坏了市场经济的公平竞争秩序、损害了广大消费者的利益，而且影响了我国市场经济的健康发展。而我国反商业贿赂法律概念界定不够清晰、法律规定不够完善使得商业贿赂的治理面临种种困难。本文分析了现有法律规定的不足，并通过对美国、德国和香港的反商业贿赂法律比较，对我国反商业贿赂的法律规定和制度设计提出建议。

Study on the Juridical Rules of the Commercial Bribe

As an illegal competitive behavior, the Commercial Bribe is a certain kind of corruption. The Commercial Bribe not only disturbs the normal competitive order of the Market Economy, damages the interests of consumers but also hinders the healthy development of the Market Economy. It is very difficult to solve the problems brought by the Commercial Bribe because the legal definition of the Commercial Bribe is not definite and the related laws about the Commercial Bribe are notperfect. The essay analyzes the deficiency of the present law about the Commercial Bribe, makes the comparison among the laws about Anti- Commercial - Bribe in the U. S. A, Germany and Hongkong, and gives suggestions to the rules and designs of Anti-Commercial- Bribe in China.
