CEPA框架下内地与港澳知识产权法律冲突与解决

CEPA作为一种新型的区域贸易安排,对促进内地与港澳经济发展有相当积极的作用。随着CEPA协议的进一步实施,越来越多的港澳产品与服务进入内地市场,由此带来的知识产权法律冲突问题也日益凸显。在解决内地与港澳地区知识产权法律冲突时,应坚持"一国两制"原则,内地与港澳地区经济整合和发展原则,以及优先适用内地与港澳地区共同参加的知识产权国际条约原则;解决上述法律冲突的最佳方式是三地协商制定一个区域知识产权合作协议。

Conflict and Resolution of Intellectual Property Right Institution Under CEPA Framework

As a new type of regional trade arrangement,CEPA will play an active role in facilitating the economy development of mainland China and Hong Kong and Macao.With the implementation of CEPA,more and more commodities and services get into the mainland market,as a consequence of ever increasing conflicts on intellectual property rights institution.The paper analyses the forms and reasons of the conflicts and proposes the principles of resolving the conflicts and the corresponding suggestions.
