| 摘 要： | 国家赔偿法的出台开辟了国家侵权损害救济的新渠道,为国家机关违法行使权力设置了有效制约机制.但是,在精神损害赔偿方面的规定尚不明确,这不利于公民精神权利的保护.人格权是公民依法享有的一项最基本的宪法权利,一切国家机关、个人、团体、组织都应当以宪法作为活动的根本准则.国家机关工作人员因违法行使职权侵犯公民人格权并造成损害的,国家同样应当承担赔偿责任.在国家赔偿法中强化精神损害赔偿的规定已是大势所趋.
