| 摘 要： | 犯罪构成要件事实的认定是定罪过程中最关键的环节,以法律思维方式为视角,探讨了构成要件实事认定的基本方法,认为在认定构成要件事实的过程中,应该从规范到事实、从形式到实质、从客观到主观、从类型到特殊,谨慎地认定案件事实。
