论公民基本权利限制的基本原则

公民基本权利是宪法所规定的公民在国家和社会生活中最主要的权利.公民基本权利进入行为领域,都应受到限制,但对限制公民基本权利的国家行为应实行更为严格的"限制".对公民基本权利的限制应遵循下述原则:(1)不损害基本权利本身原则.不能只见限制,不见权利;(2)法律保留原则.对公民基本权利的限制,应由全国人大及其常委会的立法进行;(3)明确化原则.限制公民基本权利的法律条文的文意,应具体明确;(4)司法审查原则.对限制公民基本权利具体行为,公民相对人可提起司法审查.

On the Principles of Restricting Citizen's Fundamental Rights

Fundamental rights are the primary rights of citizens in social life which are stipulated in the constitution.Because fundamental rights can be realized in the form of conducts,they must be restricted.But we must restrict strictly the state conduct which is applied to restrict fundamental rights.In detail,the following principles should be obeyed.The first is the principle of'not damaging fundamental rights'.The second is the principle of'legal reservation'.The third is the principle of 'explicitness'.The fourth is the principle of'judicial review'.
