| 摘 要： | 在现代社会,宪法具有根本法的地位已经得到认可,但宪法是否还是公法却有诸多疑问。从其他大陆法系和地区的现行立法和理论来看,宪法仍然具有公法属性。从美国宪法的发展来看,其宪法只规范国家行为,具有实质上的公法属性。我国也有越来越多的学者认识到宪法具有公法属性。
