论监狱劳动管理行为的性质

单纯的组织标准或者权力性质标准在认定职权行为性质的时候都存在问题，因此在分析监狱的职权行为性质时应结合形式标准与实质标准。从我国的政策以及监狱行使权力的性质来看，监狱应当是司法机关与行政机关的混合体，同时拥有行政权与司法权。判断监狱的行为性质的关键是该机关在行使什么权办。监狱时罪犯的劳动管理权是一种行政权，具有行政权所具有的执法性、主动性，不具有最终性的特性。

On the Nature of Prison Labor Supervision

The standard of organization or the standard of power has some problems in distinguishing between the executive power and jurisdiction. Therefore we prefer to the standard which combines the merits of standard of organization and power. According to the relevant policies and nature of its power, a prison has both the executive power and jurisdiction. But in the case of labor supervison,it only has the executive power.
