论婚姻的属性——以关系契约为视角

虽然婚姻自治已深入人心,但婚姻契约观一直受到各种各样的质疑,而关系契约理论为婚姻的契约属性提供了一个新的理论视角。在婚姻关系中,交换、选择和未来意识共同交织于以婚姻家庭为基础的社会中,婚姻具备了成为契约的前提要素。但婚姻并不是普通的契约,婚姻是一种长期契约,婚姻契约具有不完全性,婚姻中的当事人既是婚姻共同体的成员,又是具有独立利益的个体,关系规范、社会规范和法律规范共同调整着婚姻契约。用关系契约解读婚姻,能够更加理性和客观地界定婚姻的性质和特点,为婚姻法律制度的设计提供理论基础。
