| 摘 要： | 告知义务是医师的法定义务，但我国法律没有明确的标准规定，在学术界也存有不同的认识。笔者针对目前医师告知义务标准常见的五种学说进行分析，提出采用以合理患者标准为主并结合具体患者情况的标准。实践中，确定医师告知义务标准时应主要考虑告知的内容以是否会影响患者对诊疗措施的取舍为判断标准及受客观科学技术发展条件的限制。 |

| Abstract: | The duty of disclosure is doctors' legal duty,which,however,lacks definite standards in laws as well as in academia in China.The author first analyzes five theories commonly observed at present in relation to the standards for doctors' duty of disclosure.Then,it is suggested that reasonable patient standards and specific patient standards be integrated with the former given priority to.In practice,doctors should largely take into account whether what will be informed to patients would influence the patients... |
