| 摘 要： | 在法学语境中,民间法一词至少在两种意义上被使用:乡民社会中的传统民间法和市民社会中的现代民间法。因此,将民间法等同于传统本土资源,认为追求现代性就必须坚持国家法在法律发展中主导地位的观念是不正确的。民间法从传统向现代的演进遵循着一条螺旋上升式的进化路线。它的自我发展离不开社会的推动、国家法的宽容和在意识形态上达成的共识。

| Abstract: | In the context of jurisprudence,the term "folk law" has been used at least in two meanings: the traditional folk law in rural society and the modern folk law in urban society.Therefore,it is incorrect to regard the folk law as traditional local resource and to insist on the leading position of state law in modernization of law.The evolvement of folk law from traditional to modern is an evolving route of ascendant helix.Its self-development depends on the social advancements,tolerance of state law and ideological consensus reached. |
