航空产品责任诉讼的实践困惑及其价值探析

国际社会人本化趋向下，以产品责任为诉因的航空争议诉讼是保护消费者权益的重要途径，以此为主体的司法活动研究具有重要的理论和实践意义。目前，国内外对此问题的研究甚少，特别是在实际操作及适用性方面存在着一定的困惑。针对国内外在此领域的研究和司法实践现状，提出产品责任引入国际航空争议诉讼中的法律作用，即在平衡产品制造商、航空公司和消费者三者综合利益的基础上，应以保护人权和尊重人的生命价值为中心，侧重保护航空运输消费者的利益。
