论申请撤销仲裁裁决的管辖

本文分国内、涉外和海事三大类梳理了我国现行法律和司法解释中有关申请撤销仲裁裁决的管辖规定，并指出：申请撤销经依法批准设立并登记、能够以自己的名义独立受理案件并作出裁决的仲裁委员会分支机构所作出的仲裁裁决的，由该分支机构所在地的中级人民法院管辖；申请撤销海事仲裁裁决的，由仲裁委员会所在地的海事法院管辖，如无则由；建议今后修订法律时将地域管辖统一由仲裁委员会所在地法院修改为仲裁地法院。

The Jurisdiction of Applying To Repeal Arbitral Award

This article summarizes the provisions as to the jurisdiction of applying to repeal arbitral award in our current law and judicial interpretation from three categories of domestic arbitration, arbitration involving foreign concerns, and maritime arbitra- tion. As is pointed out in the article, to apply to repeal the arbitral award made by the branch of an arbitration committee, it shall be established and registered legally and be able to accept cases and make awards independently. Further, it shall be under the jurisdiction of the intermediate peopleg court where the branch is located. To apply to repeal the maritime arbitral award, it shall be put under the jurisdiction of the maritime court where the arbitration committee is located, if there is none thus under the jurisdiction of the nearby maritime court. The article proposes that the territorial jurisdiction from the court where the arbitration committee is located be unified into the court of the seat of arbitration when we amend the law in the future.
