浅析海事国际私法中的船旗国法原则

船旗国法,是指以国旗或特定标志旗作为连接点的系属公式。在船舶物权、海上侵权行为、海难救助、共同海损和海事赔偿责任限制等方面,船旗国法原则是重要的法律适用原则。但是,船旗国法原则的适用有着严格的条件、特定的范围和较大的局限性。因此,包括我国在内的许多国家并没有把船旗国法原则作为一条普遍适用的海事冲突法原则。

On the Principle of Flag Law in Marine International Private Law

Flag law is a kind of formula of applicable law which uses national flag or certain symbolic flag as junction.The principle of flag law is quite essential in the application of law in ship's property rights,infringement on the sea,salvage,general average,limitation of liability in maritime claims,etc. At the same time,there are strict conditions,special scope and relatively large limitation in the application of this principle.As a result,quite a lot of countries,including China,don't have it as a principle of maritime conflict law with general application.
