| 摘 要： | 希腊悲剧《安提戈涅》揭示出:刑法规范一旦与人之常情冲突并"绝对"执行,将导致更多的惩罚并遭到百姓的反对,不仅给当事人和其他人带来不幸、痛苦,还会给国家造成灾难。因而这部悲剧亦可解读为刑法的悲剧。安提戈涅以常情对刑法的反抗行动具有正当性,她的死亡悲剧乃刑法之悲剧。刑法悲剧的审美意蕴在于,它闪烁着人性的永恒光辉,展示了生命存在的意义及矛盾,解说了"什么是刑法"的形而上学问题。只有用良心联结刑法与常情,才能赢得真正的自由。
