两大法系行政法的比较及其启示

当下中国行政法治无论是在实践方面还是在行政理论研究方面,都需要形而上层面的基础理论来贯通理论和实践。本文在对两大法系行政法的发展进行比较和分析的基础上,得出两大法系行政法的外在形式差异和实质思维的内容差异及在宪政理念下他律和自律并行的行政权控制体系的启示,以此给我国行政法治建设提供借鉴。
