亚里士多德：实践理性与法

实践哲学的传统可以追溯到古希腊的亚里士多德。在亚里士多德那里,实践是不同于科学认识和生产技艺的行为选择活动,实践理性则是人类判断与选择正当行为的能力。由此,亚里士多德把规范人类行为的法律置入了人类实践的语境,从而获得了一种实践理性的理解。首先,作为行为指引的“实践理性”可被用来作为法规范的论证基础,即正当法源自于言说、论辩与对话;其次,法学的知识属性为实践之知;最后,实践理性的预设为存在一个能够充分自由对话的场域。

Aristotle: Practical Reason and Law

The tradition of Praxis philosophy can be traced back to the Greek master Aristotle.Aristotle takes praxis as the conduct choice activity which is different from the knowledge of science and practice skill and practical reason is the ability that human can properly make judge and choice of conduct.And then Law which regulates human conduct is taken into system of human praxis by Aristotle,so law can be reasonably comprehended through practical reason.Firstly,practical rational can provide argumentation for legal norm and the right law is ultimately decided by talk,argument and discourse.Secondly,jurisprudence belongs to Praxis knowledge.Finally,the premise of practical reason presents a region where human can be free to communicate and discourse.
