论现代社会转型视野中的制度伦理

制度伦理建构不应被简单地理解为＂制度伦理化＂或＂伦理制度化＂,而应当被理解为对制度自身的伦理属性以及对制度在社会伦理生活中的功能定位、作用方式的反思、批判与重建。制度伦理构建是现代社会转型的内在要求,它一方面表明制度的伦理基础的现代变革,另一方面表明制度必须在现代社会伦理生活中起着主导性的规范作用。制度的主要功能在于平等地保障现代个体的自由与权利,而对那些可能损及他人自由与权利的行为进行强制性规范则是其主要的作用方式。

On Institutional Ethics in the Perspective of Modern Transition of Society

Construction of institutional ethics should not be simply understood as ＇institutional ethicalization＇ or ＂ ethics institutionalization＂. In stead, it should be understood as the reflection,criticism and reconstruction of the ethical nature of institution itself and the function orientation and action mode of institution in modern social ethical life. Construction of institutional ethics is inherent requirement of modern society, because on the one hand it shows modern renovation of the ethical foundation of institution, and on the other the dominating normative role of institutions in the ethical lives of modern society. The main function of institution is equal guarantee of modern individuals＇ freedom and rights, which is effected principally through coercive correction of acts that possibly impair others＇ freedom or rights.
