| 摘 要： | 传统中国的和谐社会观与无讼观是建立在片面追求和谐而把公正置于其次的基础之上,它只能形成短暂的表面的社会和谐。只有建立在公正基础上的和谐社会才是真正的和谐社会。公正的司法是解决社会冲突的一个制度化出口,也是维持社会和谐的安全器。中国要构建社会主义和谐社会就必须谋求司法独立,实现司法公正。

| Abstract: | The traditional idea of harmonious society and no-litigation was founded on the basis of harmonization much more than justice,which can only maintain a superficial and short harmony.A real harmonious society must be based on justice.Justice of judicature is a ruled exit of social conflict,and it is a safety mechanism of a society.With the purpose of construction of a harmonious society,China should realize the independence and justice of judicature. |
