| 摘 要： | “防卫过当”和“无过当防卫”是正当防卫理论的重要组成部分，新刑法增加的“无过当防卫”内容，有利于鼓励人们进行正当防卫。防卫过当和无过当防卫是一对对立的概念，无过当防卫实质上是对防卫过当范围的限制，正确认识防卫过当和无过当防卫在主体、对象及主观方面的不同，从而正确区分，对于正确适用正当防卫有着重要意义

| Abstract: | Over-defence and boundless defence are import ant parts of justifiable defence theory. The new criminal law increases boundles s defence, which encourages people to defend properly. Boundless defence essenti ally confines over-defence, thus, the clear recognition of the constitution of over-defence and boundless defence and the correct distinction between them are very important for people to apply justifiable defence correctly. |
