| 摘 要： | 商法的价值是指商事法律规范对于社会和个人及其群体的积极意义。它体现商法精神 ,统领商事立法、执法和司法的全过程。商法作为带有公法化倾向的私法 ,既具法的一般价值 ,又有其自身的特殊价值。国家、个人、社会或营利皆不能作为商法本位。将贸易本位作为商法本位 ,既符合商法发达史的实际 ,也与现代商法发展的主旋律合拍。贸易本位是商法价值的基础。交易效率价值、交易安全价值和交易公平价值构成了当代商法的三大基本价值

| Abstract: | The value of commercial laws means that the commer cia l laws and regulations act positively on society, the individual and the masses. It embodies the spirit of commercial laws and runs through the whole process of legislation, enforcement and administration of justice. As a kind of private law intended for publicization, commercial laws have their own special value just l ike other laws. Trade standards, rather than the nation, individual,the society or profit-seeking, should be regarded the standards of commercial laws. This n ot only accords with the history of commercial law development, but is also in keeping with the trends of development of modern commercial laws. As the foundat ion of commercial laws, trade standard is comprised of the three basic values of trade efficiency, trade safety and trade impartiality. |
