反腐制度论

反腐的根本在于制度建设.从制度安排的角度看,传统中国的制度安排是在人治的框架内实现的,这种制度安排必然会导致制度“三性”（制度合理性、制度合法性、制度现实性）的缺失,成为腐败滋生的根源.现今中国的反腐必须在法治的框架内实现制度安排,即从制度的“三性”方面推进制度变革：一是反腐制度路径设计必须以“民主”价值为导向,“人民监督”为前提,体现制度的合理性；二是实现社会的公平与正义,“把权力关进制度的笼子”,保障制度的合法性；三是科学定位政府角色,限制政府成为“特殊利益集团”,保证制度的现实性.

System of Anti-corruption

The fundamental issue of the anti -corruption lies in the institutional construction. This article sug- gests from the perspective of institutional arrangements that the traditional Chinese government implements institu- tional arrangements within the framework of the rule by men. These institutional arrangements are bound to arouse the changing of Institution＇s ＂Three Properties＂ （ institutional rationality, institutional legitimacy, and institutional reality）, which constitute the sources of corruption. Nowadays, China＇s anti -corruption must implement the insti- tutional arrangements within the framework of the rule of law. Tthat is to say, the success of institutional reform must comply with the ＂Three Properties＂. First of all, the path design of the anti- corruption system must be de- mocracy- oriented, taking＂public supervision＂ as a precondition, and reflecting the rationality of the institution. Secondly, the anti -corruption should achieve social fairness and justice, capturing the power in cages to protect the legitimacy of the institution. Thirdly, the government role should be scientifically oriented, restricting govern- ment to become the ＂special interest groups＂. Only doing so may we fundamentally improve the construction of clean and honest government.
