| 摘 要： | 技术创新的法律保障体系是指实现技术创新的政策与法律环境,它对于构建本国创新体系具有重要的导向作用。比较研究中美两国技术创新的法律保障问题,包括行政管理措施、优惠政策措施、技术转移机制、技术标准以及司法保护等,能有助于我国完善相关的法律和政策,推进技术创新的发展步伐。

| Abstract: | Through making comparison between China and America on legal security system for technology originality,this article points out the current situation and problems of technology originality in China and holds that the relative measures of policy and law from the government for reference are required to change such a situation and solve the said problems,which includes subject relation,government management,fiscal support,technology transfer and judicial protection in respects of technology originality.In this way,the legal security system of technology originality means the policy and law environment beneficial to technology originality. |
