| 摘 要： | 矿难防控是我国建设社会主义和谐社会伟大进程中必须高度重视的重要问题。刑法措施作为防控矿难的最后手段和措施，在矿难防控体系中应当充分发挥其强大的规范功能和保护功能。我国现行矿难防控刑法机制在刑法结构、功能、适用中存在诸多不足。为了形成良性的矿难防控刑法机制，必须通过增设新罪、实现刑法与行政法的良好衔接，增设过失危险犯罪，增加单位犯罪主体，丰富刑罚种类等方式完善矿难相关犯罪的立法，通过理顺刑法运作过程、改进刑事司法来实现。
