非公民的少数群体成员身份国际规则解析

随着国际上人员流动的增加，外国人的人权保护问题越来越成为一个人权法领域的突出问题。由于许多外国人不具有居留国的公民身份，若想在居留国保持自己的传统文化．就必须在理论上归属于少数群体成员从而享有人权法上的特殊保护。少数群体保护的目标包括禁止歧视和特殊保护两个方面,就禁止歧视而言,少数群体享有与其他多数群体成员同样的基本的人权；而在特殊保护方面，少数群体成员享有特殊的保持文化传统的权利。本文试从少数群体权利保护的法理入手,结合联合国以及欧洲人权保护的实践．探讨非公民的少数群体成员身份问题。
