| 摘 要： | 对照目前域名与注册商标权冲突的普遍性和多样性，首先通过对域名权的权利性质进行分析，得出域名权属于名称权的结论。其次，进一步分析名称权与商标权各自的权利范围，并结合法律对驰名商标的特殊保护，具体探讨了域名与商标权冲突的解决办法。

| Abstract: | By contrast with the university and diversity of the conflict between domain name and trademark right at present,this paper analyzes the legal attribute of domain name and demonstrates that the right of domain name is a designation right.Then it analyzes the respective legal region of the designation right and trademark right,and explores the sdution to the conflict in view of special legal profection. |
