| 摘 要： | 本文在了解国际条约及各国法律特别是我国关于著作权的相关规定的基础上,探讨了著作权人与作品使用人之间的利害关系并寻求解决问题的最佳途径,提出了作品复制件所有人行使所有权与著作权的法律冲突及解决办法,指出著作出租权应当被确认为著作权人的一项独立权利。

| Abstract: | On the basis of understanding the international treaty,laws of different countries,and especially the related regulations of copyright in China,the paper discusses the relationship between the copyright of the authors and the users of the works,and finds the best way to solve the problem.It not only presents the law conflicts between the ownership right of the copy the works and the copyright,but also puts forward that the rental right of works should be regarded as an independent right of the owner of the works. |
