＂法庭之友＂是英美法系国家国内法庭的重要参与者,也已引入国际法。但是在投资者—国家仲裁中,法庭之友的参与还是最近几年的事情。根据北美自由贸易协定（NAFTA）、解决投资争端国际中心（ICSID）仲裁规则、双边投资条约（BIT）及自由贸易协定（FTA）中及NAFTA仲裁庭和ICSID仲裁庭的仲裁实践对法庭之友不同程度的授受,以及国际上非政府组织（NGO）的蓬勃发展,可以预期,在投资者—国家间投资争端仲裁中＂法庭之友＂的参与将成为普遍现象。这有助于投资者—国家争端解决机构注意被忽视的东道国公共利益,从而提高其裁决的正当性。

The Involvement of Amicus Curiae into Investor-State Arbitration

The amicus curiae is an important actor in domestic courts, and it has also been introduced to international law for a long time. However, the involvement of amicus curiae into Investor- State arbitration only happened in recent years. We can expect that the involvement of amicus curiae into Investor- State arbitration will become a universal phenomenon according to the arbitral practices of NAFTA and ICSID, the acceptance of amicus curiae by NAFTA, ICSID, BITs, and FTAs, and international non- governmental organization in full flourish.
