| 摘 要： | 证明责任分配指在民事诉讼中,当要件事实真伪不明时,由哪方当事人承担由此带来的不利后果。关于证明责任分配的学说多种多样。在我国,由于多种原因,现行法律对证明责任分配规定较为简单、笼统,并存在不少缺陷。因此,有必要对我国证明责任分配标准加以完善。

| Abstract: | Distribution of the burden of proof means which party in civil lawsuit should bear the bad consequence when the essential facts cannot be proved true or false.There are many theories of it,but in current Chinese law its provision is simple, general and incomplete. Therefore, it is necessary to improve the distribution standard. |
