高校管理权与学生受教育权的冲突与平衡

摘    要:本文首先从高校依法享有自主管理权与学生依法享有受教育权以及高校与学生之间的特别权力关系阐述了高校管理权与学生受教育权冲突形成的基础;接着从权利相互性理论出发,从权力特性与权利对权力的接受性角度对高校管理权与学生受教育权之间的冲突进行了具体分析;最后通过解释权利衡平与权力通约理论,提出了平衡高校管理权与学生受教育权的具体措施,即法律保留原则、比例原则与正当程序原则以及司法审查原则.

Abstract:This article expatiates the reasons for the conflict between the legal right of independent administration on the part of colleges and universities and the right to education on the part of the students, by exposing the special power relationship between the school authority and the students. It then analyzes the conflict from the perspectives of power reciprocity, character of power, and the recipience of rights to power. Finally, by explaining the right-equity theory and power-commensuration theory, it puts forward some operable principles for compromising the two rights, namely, the legal-reservation principle, proportion principle, due-process principle, and judicial-review principle.
