欧盟司法与内务合作的政府间主义探析

欧盟司法与内务合作的发展过程主要体现为各成员国的政府间行为,其决策机制突出体现了政府间主义性质。成员国间的共同国家利益是欧盟司法与内务合作的动力和限度。尽管欧盟司法与内务合作在范围和深度上有了很大的发展,甚至在决策机制方面引入了超国家主义因素,从而在该领域形成了以政府间模式为主、超国家模式为辅的混合决策体制,但由于涉及各成员国敏感的国家主权和国家利益问题,在相当长的时期内,欧盟司法与内务合作仍将继续采取政府间合作模式,不会突破目前政府间性质的合作框架。

Cooperation on Justice and Home Affairs in EU from the Angle of Intergovernmentalism

The developing process and policy-making mechanism of the Cooperation on Justice and Home Affairs in the EU present the characteristics of Intergovernmentalism.The common national interests among member-states are the great impetus to the Cooperation on Justice and Home Affairs in the EU.Because containing some elements of Supranationalism,the Policy-making mechanism of the Cooperation on Justice and Home Affairs in the EU becomes a mixed decision-making mechanism which has the primary characteristic of intergovernmental pattern and the subsidiary characteristic of supranational pattern.Although the Cooperation on Justice and Home Affairs in the EU has made a great development,it would still remain in the frame of intergovernmental pattern in the foreseeable future because it is involved in the sensitive issues of national sovereignty and interests.
