上海自贸区司法改革需求及改革创新思路

上海自贸区建设是国家进一步深化改革和扩大开放的国家战略,在《中国(上海)自由贸易试验区总体方案》的指引下,国务院及其部委和上海市政府等行政部门出台了针对上海自贸区建设的具有特殊性的具体管理制度。同时,上海市第一中级人民法院、上海市第二中级人民法院和上海国际经济贸易仲裁委员会陆续发布了自贸区司法建设的相关规范,以"先行先试"的司法改革策应自贸区"先行先试"的经济改革。本文在分析上海自贸区司法改革需求的基础上,结合诉讼、仲裁、ADR等方面的司法制度建设,指出司法改革的创新思路,以期为国家自贸区建设战略的有效实施提供参考。

The demands and innovative measures of judicial reform in Shanghai FTZ

Shanghai FTZ construction is the national strategy to further deepen reform and open wider to the outside.Under the guidance of ＂the overall program of China（ Shanghai） Free Trade Zone＂,the State Council and its ministries and the Shanghai Municipal Government formulated specific management system. The Shanghai first intermediate people＇s court,the Shanghai second intermediate people＇s court and the Shanghai international economic and trade arbitration commission has issued the relevant norms of FTA judicial construction so as to enhance economic reform. Based on the analysis of the needs of judicial reform combined with the judicial system construction of the litigation,arbitration,ADR and so on,the paper puts forward innovation measures for judicial reform in order to provide reference for the effective implementing of the national strategy of Shanghai FTZ.
