农村土地流转法律规制的宪法学思考

由于土地财产权自身的特殊性，以及中国背景下土地问题面临的现实困境，我国法律对农村土地流转作了一些限制。关于农村土地流转的大多法律规制同我围宪法的规定和原则相一致，但个别法律规制可能过于严格，同宪法保护财产权的目的相左，存在合宪性问题。要破解法律规制的合宪性问题，需要完善农村社会保障体制，提高农村城镇化水平，加强基层民主建设，健全土地流转市场。

Constitutional thinking on the legal limitations to the land circulation in countryside

The reason of legal limitation to the land circulation in countryside was determined by the particular character of land property, and linked with the constitutional limitations and the reality factors. Some legal limitations are so strict to violate the constitutional goal of protecting property rights, which needs to be reviewed by the constitution. The measures must be taken to solve this problem, including improving the safeguard system, urbanization level, democracy, and the market of land circulation in rural communities.
