| 摘 要： | 近代民法上物权变动法制存在着意思主义与形式主义的对立 ,法国法与德国法分别为其典型代表。作为比较有代表性的理论 ,对于二者不能简单地认定孰优孰劣 ,应该具体问题具体对待。我国民法是承认物权行为的 ,但相关的立法尚有待进一步的完善。

| Abstract: | In modern civil law, there are two contradictory the ories about the tr ansference of the real right, formalism and idea doctrine, which are typical res pectively in German and French. It is difficult to say which is more advanced be cause each of them has its strong points. The system is conformed in China's law , so we analyze the present stipulation on the transference of the real right in China and give some advice to improve China's legislations. |
