社会系统论视域下市场经济与知识产权制度的“耦合性”分析

从社会系统的视角研究,可以发现市场经济与知识产权制度在功能上存在"创新与激励"、"资源配置与利益平衡"、"知识流动与产权保护"的"耦合性"。但须明确的是,只有知识产权制度与市场经济发展水平保持协调,二者功能才会形成"耦合"并促使市场经济与知识产权制度良性互动发展。

Analysis of the Coupling Characteristics between the Market Economy and the Intellectual Property System under the View of Social Systems Theory

Three coupling characteristics can be found between the market economy and the intellectual property system from the perspective of the social system,that is,innovation and incentives;allocation of resources and the balance of interests;the flow of knowledge and the protection of intellectual property rights.However,it is clear that both functions will form the coupling and promote the market economy and the intellectual property system to positive interaction as long as the intellectual property system maintains coordination with the level of the market economic development.
