试论国有企业重组改制及其商标权保护

近年来,我国国有企业资产重组改制频繁,在国有企业实行股份制改造、兼并及与外商合资的过程中,由于商标权保护意识淡薄和对商标权评估的失误,造成国有企业商标权这一巨大无形资产流失和权属纠纷增加。本文试对这一问题进行分析,剖析其深层次原因,提出了国有企业在重组改制中对商标权保护的对策,并针对商标权的评估给予重点论述。

Discussion on the Restructuring and Reforming System of the State-owned Enterprises and Their Trademark Priviledges Protection

In recent years,the state-owned enterprises of our country have been frequent in recombination of assets.During the process of implementing shareholding system transformation,annexing and introducing foreign joint capital,the faint protection consciousness and the improper assessment of the trade mark privileges have caused the enormous intangible assets serious loss and the disput of ownership on the trade mark to increase.This author tries to carry on the analysis to this question,analize the in-depth reasons,produce the countermeasures for the trade mark priviledges protection in the process of the state-owned enterprises reform and aim at the appraisal of the trade mark priviledges to give the key demonstration.
