试论信托受托人谨慎义务的标准

作为信托事务中受托人最基本的义务之一,谨慎义务在我国的立法中没有明确的标准.通过介绍英、美、日、韩及我国台湾地区的信托立法例,比较了这些国家立法中受托人的谨慎义务标准,结合我国立法与司法实践,建议在我国<信托法>中增加三个条款:确立我国<信托法>中受托人的谨慎义务标准;增加受托人责任豁免条款;区分一般受托人和专业受托人的注意义务标准.

Standard of Trustee's Prudent Obligation

The trustee's prudent obligation is one of the basic obligations in trust,but there is no clear standard in Trust Act of China.This paper compares the legislation of the standard of the trustee's prudent obligation in the U.K,the U.S.A, Japan,Korea and the Taiwan.Combining Chinese legislation and law practice,it suggests that Chinese legislation should add the following three articles so as to perfect the trustee's standard of prudent obligation in Trust Act.First,to establish the standard of the trustee's prudent obligation in Trust Act,second,to include the article of exempt of trustee's obligation,and third,to distinguish care duty standard of the common trustee and the professional trustee.
