新农村建设中宅基地使用制度改革浅议

我国现行法律对农村建设用地进入市场采取了分类严格限制的办法。随着农村经济的发展以及城镇化进程的加快，现实中存在大量宅基地使用权的隐性流转。现行的宅基她管理制度亟待改革和完善。农村建设用地市场必须在政策和法律上寻求根本突破，必须从井艮瓠上改变土地制度的二元性，统一城乡土地市场。建议完善宅基地使用权登记制度，建立有偿、有期限宅基地使用制度，逐步放宽宅基地使用权的流转，充分保障农民在集体建设用地流转中的权益。

Therefore, the existing management system of homestead needs improving. It is proposed that the market of constructive lands in rural areas need to seek a fundamental breakthrough in policy and law, including changing the duality of land administration system, unifying urban and rural land markets, improving the registration system of homestead usufruct, setting up a compensated use system of homestead, and relaxing the flow and transfer of homestead usufruct, thereby protecting the interests of farmers adequately.
