| 摘 要： | 《刑法修正案(八)》是我国社区矫正立法化进程中的里程碑,我们应该顺势而为,从以下方面继续推进我国社区矫正立法化:第一,明确认定社区矫正行刑性和社会性双重法律属性;第二,适时制定《社区矫正法》;第三,明确司法行政部门是我国社区矫正的执行机构;第四,规定社区矫正官为我国社区矫正的执法人员;第五,加强自治型社区建设,推进社区建设和社区矫正良性互动发展。 |
