沿海滩涂产权的复杂性及其解决方式

沿海滩涂是由潮上带、潮间带和潮下带滩涂三部分组成的处于海洋和陆地交汇处的资源,因其既有陆地资源的属性,又兼具海洋资源的特性,决定了其在产权属性上既有土地产权的特征,也有海洋产权的特性。然而在现实中,因为滩涂概念界定不清晰、产权残缺、征用滩涂引起的产权变化等因素导致滩涂占有和使用混乱,为此必须通过清晰的滩涂概念界定、完善各项制度并实现各种制度之间的协调来完善沿海滩涂的产权制度。

The Complexity of the Coastal Tidal Land Property Rights and Its Solutions

Coastal tidal flat is resources formed by the supratidal,intertidal and subtidal shoals in the intersection of the marine and terrestrial areas.Because of its attributes of marine and land resources,it has characteristics of both land and marine property.However,because in reality the concept of coastal tidal flat is not clearly defined,its property rights are incomplete,and there is disorder in possession and use of coastal tidal land,caused by changes in property rights owing to its expropriation.Therefore,we have to clearly define the concept of tidal land,perfect the systems and ensure coordination between the various systems to improve the system of coastal tidal land property rights.
