关于专利侵权的惩罚性赔偿的思考

为遏制猖獗的专利侵权,必须引入惩罚性赔偿,将故意侵权作为惩罚的对象。专利侵权的惩罚性赔偿数额以赔偿基数的两三倍为宜。在确定惩罚性赔偿的具体数额时,需要考虑侵权后果,包括直接物质的损失,也要考虑商誉损失及社会影响;要考虑侵权人的侵权获利情况和侵权人财产状况、支付能力;要考虑侵权的时间长短、侵权的频率;要考虑侵权手段、方式、场合。专利侵权的惩罚性赔偿应与我国的科技实力、经济水平和社会发展状况相适应,防止权利滥用、制度滥用和制度异化。

In order to curb rampant patent infringement,the system of punitive damages must be established to prescribe the intentional torts as the object of the punishment.It is appropriate for punitive damages in patent infringement compensation accounting for two or three times of the amount of compensatory damages.For determining the specific amount of punitive damages,the consequences of the violation should be considered,including direct material losses,the loss of goodwill and social impact,the profit situation of infringement of the infringer and his（her）personal properties,concluding his（her）capacity of paying.the length of time and the frequency of tort infringement,the means of infringement,and the occasion must be considered as well.The system of the punitive damages for patent infringement should adapt to China＇s scientific and technological strength,the state of the economy level and the development of society.Rights and system should be prevented from abusing,and it is also necessary to avoid the alienation of the system itself.
