我国隐性新闻采访与隐私权的冲突与平衡

目前在我国新闻采访的实践中,尽管隐性采访尚未获得明确的法律认可,但由于这一方式确实有助于保障实现公众知情权,有效实现舆论监督,因此,为新闻媒体所经常使用,也受到公众的认可。但是,应该看到,隐性采访形式的使用也常常会引发对个人隐私权的侵权行为,导致一系列冲突。本文通过对冲突状况的分析,对国内外解决这一冲突的法律规范的辨析,寻找解决冲突的法律和道德约束条件,为隐性采访与隐私权的平衡提供有益的思路和相应的解决路径。

Conflict and Balance between Covert Coverage and Rights of Privacy

Though covert coverage hasn’t been granted with the legal status,it is widely employed as one of the news coverage practices in China.On one hand,it serves to guarantee the embodiment of rights to know.On the other hand,it tends to cause violations of rights of privacy,leading to conflicts in succession.This paper attempts to seek for both legal and moral constraints to tackle the conflict and put forward an effective thinking and solution to consequently strike a balance between covert coverage and rights of privacy by analyzing the conflicts and studying the legal regulation in regard to them at home and abroad
