| 摘 要： | 从伦理学角度看,行政处罚是具有伦理意义且需伦理规约的行政行为;行政处罚的伦理向度是公序和公益,消解"内部性"问题和"私人化"问题是其内在要求;行政处罚的伦理考量是"矫正正义"具体落实,其实体性要求是:罚其必罚,平等对待,罚当其过,合乎人道。

| Abstract: | In the view of ethics, administrative punishment is a significant action that requires ethical regulations and control. The ethical orientation must be public order and benefit with the internal demand to solve "internal problems" and "private problems"; while its ethical standard should be pursued in the concrete realization of the idea of "rectified righteousness" with the essential guideline of equality to punish the punishable according to a humane principle. |
