行政起诉权保障与行政案件受理制度的完善

行政起诉权是现代宪政国家公民和组织的一项基本权利。然而,由于现行行政诉讼受案制度忽视起诉程序的纠纷解决功能,混淆起诉要件与诉讼要件,起诉证据规定不明确,当事人缺少最低限度的程序参与,已经不能完全满足保障国民行政起诉权的需要。完善我国行政诉讼受案制度,应遵循诉权保护、程序正当、司法最终三大理念,走出"庭审中心主义"的误区,区分起诉要件和诉讼要件,建立登记立案制度,重视对起诉证据的适度把握,完善起诉的程序保障机制,强化法官在立案阶段的阐明义务并适当调整诉讼政策。

On the Guarantee of the Right to Administrative Sue and Perfect the System of Entertaining a Administrative Case

The right to administrative sue is a fundamental right for all citizens and institutions. However, the current legal system of receive-a-suit in administrative proceedings can not fully meet the needs of judicial practice, for neglecting its disputes-settling function, confusing the necessary factors of the right to sue and the litigation, lacking of clear requirements of evidence and the procedure participation of the litigant. In order to reconstructing the system of receive-a-suit in administrative proceedings, we should obey three main rules, i.e. litigious right protection, due process and judicial end, avoid the misunderstanding of procedure center, distinguish the necessary factors of the right to sue from those of litigation, establish case registration system, properly investigate the evidence offered when bringing a suit, improve the protection mechanism of right to sue, emphasize the judge's obligation of interpretation in the case registration period, and adjust the policy accordingly.
